Il sera alors d\u00e9sign\u00e9 comme <strong><em>Secret de fonction<\/em><\/strong>.<\/p><p><strong>Confidentialit\u00e9<\/strong> \u00e9mane du droit priv\u00e9, principalement \u00e0 la suite d&#039;une clause contractuelle ou d&#039;un contrat. Une, plusieurs ou toutes les parties contractantes s&#039;y engagent et se l&#039;imposent.<\/p><p><strong>Non-divulgation<\/strong> est un produit de la common law dont le sens juridique n&#039;est pas apparent. Cela signifie prendre des dispositions et donner des instructions \u00e0 ceux dont on est l\u00e9galement le Garant, tels que les employ\u00e9s, les subordonn\u00e9s, les enfants etc\u2026 afin qu&#039;ils respectent un engagement de confidentialit\u00e9.<\/p><p>La non-divulgation est trop souvent confondue \u00e0 tort avec la confidentialit\u00e9 car de nombreux ignorants, professionnels ou non, r\u00e9digent des clauses de non-divulgation avec un texte de confidentialit\u00e9 : la confusion est d\u00e9sormais inscrite dans la tradition et soutenue par une doctrine bient\u00f4t majoritaire.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>The Secret originates from the law, either as attributed to a profession, then it will be called Professional Secret or as attributed to those who exercise a state authority.
