Sar\u00e0 quindi designato come <strong><em>Segreto della funzione<\/em><\/strong>.<\/p><p><strong>Riservatezza<\/strong> emana dal diritto privato, principalmente per effetto di una clausola contrattuale o di un contratto. Una, pi\u00f9 o tutte le parti contrattuali si impegnano ad esso e se lo impongono.<\/p><p><strong>Non divulgazione<\/strong> \u00e8 un prodotto di diritto comune, il cui significato legale non \u00e8 evidente. Significa predisporre e dare istruzioni a coloro di cui uno \u00e8 legalmente Garante, quali dipendenti, subordinati, figli ecc\u2026 affinch\u00e9 rispettino un impegno alla riservatezza.<\/p><p>La non divulgazione viene troppo spesso erroneamente confusa con la riservatezza perch\u00e9 molti ignoranti, professionisti e non, scrivono clausole di non divulgazione con un testo di riservatezza: la confusione \u00e8 ormai tradizione e sorretta da una dottrina presto maggioritaria.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>The Secret originates from the law, either as attributed to a profession, then it will be called Professional Secret or as attributed to those who exercise a state authority.
